The Supreme Court on Monday denied a Justice Department request to separate mail ballots from people on a federal list of about 20,000 alleged noncitizens, without asking California to respond.

  • The Supreme Court on Monday, Nov. 2, 2026, denied the Justice Department's emergency request for an injunction. The injunction would have required California election officials to set aside ballots from about 20,000 people the government calls alleged noncitizens (Source).
  • The order was one line and unsigned, with no noted dissents (Source).
  • The Court acted without asking California officials to respond (Source).

  • U.S. District Judge David Carter had earlier denied a temporary restraining order. He described the federal process as "rife with uncertainty and errors" (Source).
  • A 9th Circuit panel then rejected the request 2–1 on Oct. 30. Judges Mark Bennett and Gabriel Sanchez were in the majority, and Judge Patrick Bumatay dissented (Source).
  • More than 6 million mail ballots had been returned to California election offices (Source).
  • In a separate lawsuit, Chief Judge James Boasberg ruled Monday that the administration had likely violated the Constitution. His order bars DOJ and DHS from demanding that California officials set aside ballots based on federal noncitizen lists (Source). Axios, via search summary, did not mention the Elections Clause.

“42% of the names on the list do not appear on California's current voter roll”NPR, reporting UCLA Voting Rights Project data scientists' analysis, quoted by NPR · undercutting the reliability of the DOJ's 20,000-name list of alleged noncitizens

MSNBC led with speed, writing that the court acted "without the court even calling for a response from the opposing party first." NBC opened on "a loss for President Donald Trump" in its first words.

  • U.S. District Judge Sharon Gleason dismissed the Justice Department suit on Sunday, Nov. 1, 2026, in a 20-page decision two days before Election Day. The suit sought to pause certification of Alaska's Senate results pending an investigation into whether voters were confused by the second Sullivan. (Source)
  • Gleason called the relief the government sought "infeasible" because many voters had already cast ballots. The ballots were also commingled, so separating them would violate ballot secrecy. (Source)

CoreCivic, the private prison operator, sold its idle 1,600-bed Prairie Correctional Facility in Appleton, Minnesota, to the Department of Homeland Security for about $495.6 million, with the sale closing on August 4, 2026 (SEC 8-K); [68]. Taxpayers pay through a federal purchase. The price is "approximate" and "subject to certain adjustments," and CoreCivic's release gives the gross sales price as $495.6 million (SEC Exhibit 99.1). The filing says the facility "has been idle since 2010." Truthout's account of the earlier $75 million offer to Minnesota, and the roughly $420 million gap it implies, is not in the filing, so it stays as reported only [68]. DHS, acting for the United States, decided the purchase, and CoreCivic has "recently entered into" a management agreement with ICE for the site. That contract runs to August 2031, and ICE can end it for non-appropriation or convenience (SEC 8-K). CoreCivic expects net proceeds of about $522.5 million across this sale and a second Kansas sale, for general corporate purposes (SEC 8-K). No primary donor or lobbying record that I could open ties the seller to the buyer's decision.
